Juan is a call center agent working for 5 years at a company.


Juan was fired by his boss suddenly without giving him a separation pay.


Under the Labor Code, Juan may file a complaint with the Department of Labor and Employment.

Things to know


File your case within 3 Years.
File your complaint at the Department of Labor and Employment.
You are entitled to 1-2 months worth of salary for every year of service depending on the reason for dismissal.


Scenario



Diego bought a condo on installment.


Diego can no longer pay after 3 years but wants a refund.


Diego can claim for a partial refund from the developer under the Maceda Law.

Things to know


You can only claim for refund if you have paid at least 2 years worth of installments.
Contact the Real Estate Developer.
50% refund if 2-5 years, can go up to 90% after 13 years.


Scenario



Juan and Juana are a married couple.


Juana cheats on Juan with Diego.


Juan can file a criminal case of adultery with the Regional Trial Court.

Things to know


File your case within 10 Years
Go to your city prosecutor and file with the Regional Trial Court.
Juan can file a civil case for legal separation with the Family Court.


Scenario



Steph owes James P50,000 pesos.


Steph refuses to pay.


Even without a lawyer, James can go to the Small Claims Court to file a case against Steph.

Things to know


If loan was written contract, it can be filed within 10 years but if purely oral, it must be filed within 4 years.
File with the Municipal Trial Court/Metropolitan Trial Court.
You may file if the debt is P400,000 or less.


Scenario



Gordon is Cat's boss at work.


Gordon makes sexually suggestive comments towards Cat.


Cat can file a case against Gordon under the Anti Sexual Harassement Law.

Things to know


File your case within 3 Years.
Report the conduct to the Office where Harasser works or go to the Women’s Desk at the nearest Police Station.
Employer or Head of Office shall be solidarily liable with Harasser if they are informed but take no immediate action against the Harasser.
